Data Protection Regulations

Scope of application

Primework AG, Badenerstrasse 734, 8048 Zurich ("Primework") is a recruitment agency that runs an online platform for job seekers and companies as well as for other interested persons. Data protection is a matter of trust and your trust is important to us. We respect your privacy and make sure that your personal data is protected and processed in compliance with legal regulations. This data protection declaration explains how Primework deals with collecting, using and disclosing certain information, including your selection options and personal data. These data protection regulations relate to persons who create a profile on the www.primework.ch online platform ("platform"), apply for a job, place an advertisement and/or use the Platform in any other way ("use" or "usage"). Wherever this data protection declaration refers to the processing of your personal data, it means any dealings with your personal data. This includes, for example, the collection, saving, management, usage, transmission, disclosure or deletion of your personal data. By using this platform, you have expressly agreed with the data protection provisions given herein. 

Collection and saving of data

a) General 

When you use the platform, Primework collects both personal and non-personal information (together referred to as the "data"). Person-related data ("personal data") means data that relates to a specific or identifiable person and therefore allows conclusions to be drawn as to their identity. 

b) Registration | user account

In order to use our range of services, a personal user account must first be set up with a personal profile. As part of the registration process on the platform, various data is collected and saved for subsequent processing in order to create the user account. For this purpose, you must give your contact details such as first name, last name, address, email address and telephone number. You also have the option of uploading a profile photo of yourself in your personal user account. Your details in the user account are private and cannot be viewed by visitors to the platform or registered users.  

c) Application file

The platform gives you the option of creating an application file and applying for advertised positions. To this end, additional data is collected that is required to handle the application process. This includes personal details such as first name, last name, address, email address, telephone number and date of birth. Certain details are essential in order to use this offer. Furthermore, you are free to provide additional details which are marked accordingly on the platform. If you apply for an advertised position on the platform, you thereby give your consent for the information you have provided and documents you have uploaded to be passed onto the employer specified in the advertisement. If you use chargeable services, you can choose between various payment options such as credit card or PayPal. If you pay with a credit card, for example, the information on your credit card will be collected. However, payment is made directly via the payment system provider. The data protection regulations of the relevant provider therefore also apply.

d) Uploading files

You have the option of uploading and saving personal application documentation such as your CV or employment references to your personal user account. These documents are not publicly visible on the platform, but may be transmitted to the employer named in the advertisement in connection with the application for a specific position. 

Use of data

Data is collected in order to run the platform and for processing and administration purposes for the offered services, particularly for handling the application process and for personnel placement purposes. Data is also collected by Primework, particularly for justifying, structuring the content of, processing and amending the contractual arrangements made with individual clients as well as for standard invoicing purposes for chargeable services. The data transmitted is also used to improve our services as well as to analyze marketing activities. Primework also uses the data for its own marketing purposes. In this respect, you acknowledge and agree that Primework and related companies may send information about the platform and about new features of the platform and generally on Primework services to your postal and email addresses. You have the option at any time to withdraw your consent for your personal data to be used for marketing purposes by writing to Primework AG, Badenerstrasse 734, 8048 Zurich or emailing legal@primework.ch . By entering and uploading your personal data, you acknowledge and agree with the processing of all data collected about you in the manner described in this data protection declaration and for the purposes described herein. 

Log files

Every time you access the platform, specific usage data is transmitted to Primework for technical reasons and saved in protocol files, or log files. This involves the following usage data: date and time you accessed the platform; name of the internet site accessed; IP address of your computer or mobile device; address of the internet site you used to access the platform; data volume transmitted as well as the name and version of your browser. Analysis of the log files helps us to continue improving the platform and make it more user-friendly, to find and remove faults more quickly and to manage server capacities. We use the log files to establish the times at which usage of our Internet offers is particularly popular and to provide corresponding data volumes to guarantee optimum usage.

Disclosure of data to third parties

Primework may permit the processing or disclosure of the collected data to affiliated companies, cooperation partners and authorized third parties in Switzerland and abroad for the purposes given in this data protection declaration. The relevant data recipients with access to the data collected by Primework are obliged to comply with data protection regulations. Third-party providers receive data only to the extent required and are obliged to use the data exclusively for order processing and not for other purposes. If data is transferred across borders, Primework ensures through agreements with the data recipients that they undertake to observe appropriate data protection. Primework may disclose the collected data for a job you have specifically applied for to the employer named in the advertisement. Statutory duties of disclosure: Disclosure of data to the supervisory authorities, judicial authorities or other responsible persons is also expressly permitted if applicable law provides for this. Business transfers: Primework may transmit information, including personal data, in connection with a reorganization, restructuring, merger, sale or any other type of transmission of assets, provided that the recipient agrees to handle the personal data transmitted in a way that ensures compliance with this data protection declaration

Protection of data

Primework handles the collected data with the utmost care and discretion. Primework takes all necessary and appropriate measures to prevent personal data from being seen, destroyed, misused or manipulated by unauthorized third parties. All personal data is stored in encrypted form on servers within Switzerland. Personal data is transmitted and stored in encrypted form within Primework as well as between Primework and related companies or authorized third party providers. Communication via the platform is based on TLS encryption (Transport Layer Security). However, it is possible that data transmitted to Primework over the internet or an email service may be seen by unauthorized third parties. It is also possible that because of the nature of the internet, data may sometimes circulate through servers of third party countries, i.e. including countries that do not offer the same level of data protection. As a result, highly confidential information should not be passed on over the internet (e.g. email). Although Primework takes technical measures to guarantee the secure transmission and storage of data, there is always a possibility that unauthorized third parties may gain possession of data, for example, by hacking the platform. Primework therefore rejects liability in this regard to the permissible legal extent.

Deletion, correction of data and right to information

The owner of the data collection is Primework AG, Badenerstrasse 734, 8048 Zurich. 

a) Deletion and correction of data

You have the option at any time to have your personal data deleted or corrected by writing to Primework AG, Badenerstrasse 734, 8048 Zurich or emailing legal@primework.ch  Deleting the data will also delete your user account on the platform, including the uploaded files.

b) Right to information

You have the right at any time to ask for information about whether and which personal data about you has been stored or processed by Primework. To do so, please send a written request to Primework AG, Badenerstrasse 734, 8048 Zurich or email legal@primework.ch  

Web analysis tools

In order to continually optimize our offer and improve marketing measures, Primework collects tracking data which provides information on the surfing activity of visitors to the platform and registered users. To do this, Primework currently uses the web analysis tool Google Analytics (https://analytics.google.com/). Data including abbreviated IP addresses (abbreviation prevents the identification of specific devices) is transmitted to Google within the scope of web analysis. Google observes the data privacy provisions of the Swiss-U.S. Privacy Shield Framework and has registered with the US Department of Commerce for the Swiss-U.S. Privacy Shield (information on the Swiss-U.S. Privacy Shield can be found at https://www.privacyshield.gov/Swiss-US-Privacy-Shield-FAQs). The information generated by cookies, such as the time, location and frequency of your website visit, including your (abbreviated) IP address, is transmitted to Google in the US and stored there. Google offers a deactivation add-on for the most common browsers which gives you more control over which data is recorded by Google on the website you have accessed. The add-on informs JavaScript (ga.js) of Google Analytics that no information on website visits should be transmitted to Google Analytics. However, the deactivation add-on for browsers from Google Analytics does not prevent information being transmitted to Primework or other web analysis tools we may use. Cookies that collect tracking data do not contain any personal information, i.e. the IP address is immediately abbreviated on your access device and is therefore anonymized. This ensures that the data is transmitted and stored anonymously. Detailed information on the data collected by the relevant providers may be found on the third party’s website. 

Cookies

Cookies are used to optimize the platform and determine page views. These cookies are fully anonymized. Cookies are small files that enable specific information relating to the user's access device (PC, smartphone, etc.) to be stored on the device. They are used to make the platform user-friendly (e.g. storing login data), but also to record the statistical data about platform usage and can be analyzed to improve the offer. When accessing the www.primework.ch internet site and sites associated with this domain, it is agreed that cookies are used and therefore usage data is collected, stored and used. Furthermore, visitors to the platform consent to the data in cookies being stored beyond the end of a browser session and called up again whenever the site is revisited. Most browsers accept cookies automatically. You can influence the use of cookies. Most browsers have an option to either limit or prevent cookies from being saved. However, reference is made to the fact that the use and in particular the ease of usage are restricted without cookies. 

Interaction with social networks

The platform does not currently use any social plug-ins.

Changes to the data protection declaration

It may sometimes be necessary to amend this data protection declaration due to enhancement of the platform, implementation of new technologies or amendments to statutory framework conditions. Any significant change to this data protection declaration is immediately publicized on the platform and registered users are informed via email using the email address given upon registration or by a corresponding notification sent to a suitable area of the user account. Messages to the email address given upon registration are deemed to have been legally served. The current version of the data protection declaration may be accessed and printed at any time on the platform.
